Agreement to Terms

By using Daak's email hosting services ("Service"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use our Service.

Plain English: These are the rules for using Daak. We've tried to keep them fair and understandable.

What We Provide

Daak provides email hosting services including:

  • Custom domain email addresses (you@yourdomain.com)
  • IMAP/SMTP/POP3 access
  • Webmail interface
  • Spam filtering
  • Basic calendar and contacts sync (CalDAV/CardDAV)

What we don't provide: Document editing, file storage, video conferencing, or any features beyond email hosting.

Acceptable Use

You agree NOT to use Daak for:

  • Spam: Unsolicited bulk email, cold outreach, or marketing emails to purchased lists
  • Illegal content: Anything that violates Indian or international law
  • Malware: Distributing viruses, phishing, or malicious software
  • Harassment: Threatening, abusive, or discriminatory communications
  • Fraud: Impersonation, scams, or deceptive practices
  • High-volume sending: More than 400 emails per hour (our infrastructure limit)
⚠️ Zero tolerance for spam: We take spam very seriously. Sending spam will result in immediate account termination without refund. This strict policy is why our deliverability is excellent — we don't share IP space with spammers.

Your Responsibilities

  • Keep your account credentials secure
  • Provide accurate billing information
  • Maintain proper DNS records for your domain
  • Comply with applicable laws in your jurisdiction
  • Notify us immediately if you suspect unauthorized access

Payment & Billing

  • All prices are in Indian Rupees (₹) and include GST where applicable
  • Payment is processed securely via Razorpay
  • Subscriptions are billed annually in advance
  • Failed payments may result in service suspension after 7 days
  • Price changes will be communicated 30 days in advance

Refund Policy

30-Day Money-Back Guarantee: If you're not satisfied within 30 days of purchase, contact us for a full refund — no questions asked.

After 30 days:

  • No refunds for unused portions of annual subscriptions
  • Accounts terminated for policy violations are not eligible for refunds
  • Refunds are processed to the original payment method within 5-7 business days

Service Availability

  • We target 99%+ uptime (our infrastructure historically achieves 99.5%+)
  • We don't guarantee specific uptime SLAs for individual accounts
  • Scheduled maintenance will be communicated via email when possible
  • We're not liable for downtime caused by factors outside our control

Honest note: We rely on MXroute's infrastructure. They have an excellent track record, but we can only offer what they guarantee upstream (99% uptime).

Data & Backups

  • Your email data remains your property
  • We maintain backups as a courtesy, but don't guarantee backup availability
  • You're responsible for maintaining your own backups of critical data
  • You can export your emails anytime via IMAP

Account Termination

By you:

  • You can cancel anytime via your account dashboard or by contacting support
  • Export your data before cancellation — we delete data within 30 days

By us:

  • We may terminate accounts that violate these Terms
  • We may terminate accounts for non-payment after 30 days
  • We'll provide reasonable notice when possible
  • Termination for spam or abuse is immediate without notice or refund

Limitation of Liability

To the maximum extent permitted by law, Daak shall not be liable for:

  • Loss of data, revenue, or business opportunities
  • Service interruptions or downtime
  • Actions of third parties (including our infrastructure providers)
  • Indirect, incidental, or consequential damages

Our total liability is limited to the amount you paid us in the 12 months before the claim.

Plain English: Email hosting is a utility. If things go wrong, we'll do our best to fix them, but we can't be responsible for losses beyond what you paid us.

Changes to Terms

We may update these Terms occasionally. We'll notify you of significant changes via email. Continued use after changes means you accept the new Terms.

Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of New Delhi, India.
